Volunteer Placement Services Agreement : Disclaimer & Limitation of Liability
The following terms and conditions are an agreement between you and VolunteeringIndia.com (Experienz Travels). When you make an application for a VolunteeringIndia.com (Experienz Travels) service, you are agreeing to what is stated below.
   
You would agree to the following terms:
 
We provide with the following services:

Airport Receive/ Transfer: Our representative will greet you at the airport and will transfer you to your hotel/placement/home stay in the country you have chosen to volunteer.

Orientation: Orientation will be provided by our staff. We cover areas like, culture, greetings, locations, transportation etc. Each participant will be provided with a local Map of the city, where possible. VolunteeringIndia.com (Experienz Travels) will not take any responsibility if local circumstances do not allow for this to take place for any natural reasons beyond our control.

Lodging: Almost all placements have residential accommodation arrangements, however if that is not available volunteers will be staying with a local welcoming and educated family.

Food: 2 or 3 local meals will be provided in projects depending on the circumstances- unless otherwise specified.

In – Country travel assistance: If participants like to travel around, we provide with full support for bookings & arrangements to travel within India or Nepal only.

Language Books: We provide participants with language handbooks only in India & Nepal only.

In-country support: 24 hours support provided by our local staff. All participants will have Mobile or Landline phone numbers of local contact person.

Pre-departure information: After we receive full and final payment all participants are provided by a pre-departure information booklet by e-mail which will have all vital information about your program. Participants will also then receive their Insurance documents.
 
Payment and application process.
Once we receive your application along with your deposit payment of US$100 we will process your application within 10 days of application. We will send you a written confirmation of you application by e-mail. In certain circumstances which are beyond our control it could sometimes take a little longer than 10 days.
   
Cancellation and Refund Policy
Refund of application fee

Application fee will not be refunded under any circumstance, if the program is cancelled by the client.

Application fee will only be refunded in case VolunteeringIndia.com (Experienz Travels) is not able to provide a suitable placement to the client. We will be deducting 30% as administration charges from this refund amount.
   
Refund of program fee
Cancellation of volunteer program by client: VolunteeringIndia.com (Experienz Travels) incurs a lot of charges in order to provide placement to the client. If someone cancels the program after payment of program fee 60 days prior to departure, we would refund 70% of the program fee only. Cancellation 30 days prior to start date, the client would be refunded with 50% of the program fee only & any cancellation done with 30 days of the program start date, the client will only receive a refund of 25% of the program fee paid to us.

Cancellation after Project start date:- Under no circumstances will the program fee be refunded to the client. Application fee of US$150 will also not be refunded.

Cancellation by VolunteeringIndia.com (Experienz Travels):- Incase VolunteeringIndia.com (Experienz Travels) has to cancel the clients project due to certain natural and unnatural circumstances VolunteeringIndia.com (Experienz Travels) will refund part of the remaining time period of the project fee calculated on a pro-rata basis excluding the application fee of US$150 and 7% (seven percent) bank charges.

Payment of refunds: - VolunteeringIndia.com (Experienz Travels) will refund the applicable refund amount to the client within 100 (one hundred) days of confirmation of cancellation.
   
Use of photos and feedback
By agreeing to the terms and conditions you agree that VolunteeringIndia.com (Experienz Travels) can use your photos and written feedback while at the project to post on its website www.VolunteeringIndia.com (Experienz Travels)  might use such material for marketing/promotion in form of brochure/emails/ or on its website. VolunteeringIndia.com (Experienz Travels) also uses photos and material from our partners and affiliations abroad and in India and is not responsible for a claims arising towards that material/photos/content. The use of such photos and material can also be done on any other domains owned by Experienz Travels.
   
Seizing the agreement

VolunteeringIndia.com (Experienz Travels) will end this agreement with you in case of following reasons:-

  • If we find that you are engaged in any illegal activities or convicted of any criminal activities before or during the Project Period
  • If it is believed that any of your action or behavior is threatening or unacceptable to the society or any one involved with the project based on the judgment of the project staff and/or the in country coordinator.
  • Any information provided by you to VolunteeringIndia.com (Experienz Travels) during the time of enrollment is incorrect.
  • You voluntarily decide to opt out of the program in between.
  • If you are found taking drugs or using such material while in the project.
  • If you are found to be engaged in sexual behavior while your stay in the host family.

In case the agreement is terminated due to any of the above reasons or reasons relating to the above, you will not be entitled to any refund from VolunteeringIndia.com (Experienz Travels).
   
DISCLAIMER
A. User expressly agrees that use of VolunteeringIndia.com (Experienz Travels) is at user's sole risk. Neither VolunteeringIndia.com (Experienz Travels), its affiliates nor any of their respective employees, agents, third party content providers or licensors warrant that VolunteeringIndia.com (Experienz Travels) will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of VolunteeringIndia.com (Experienz Travels), or as to the accuracy, reliability or content of any information, service, or merchandise provided through VolunteeringIndia.com (Experienz Travels).

B. VolunteeringIndia.com (Experienz Travels) is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction or modification under the laws applicable to this agreement.

C. In no event will VolunteeringIndia.com (Experienz Travels), or any person or entity involved in creating, producing or distributing VolunteeringIndia.com (Experienz Travels) or the VolunteeringIndia.com (Experienz Travels) software/content, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages arising out of the use of or inability to use VolunteeringIndia.com (Experienz Travels). User hereby acknowledges that the provisions of this section shall apply to all content on VolunteeringIndia.com (Experienz Travels).

D. VolunteeringIndia.com (Experienz Travels) does not take any direct responsibly for the use of third party online payment facility. Paypal will not be responsible for any malfunction in their software for online payment. All disputes arising with Credit Card fraud will Directly be dealt with Paypal

E. In addition to the terms set forth above, neither VolunteeringIndia.com (Experienz Travels), nor its affiliates, information providers or content partners shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within VolunteeringIndia.com (Experienz Travels), or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. Neither VolunteeringIndia.com (Experienz Travels) nor its affiliates, information providers or content providers warrant or guarantee the timeliness, sequence, accuracy or completeness of this information. Additionally, there are no warranties as to the results obtained from the use of the information.

F. VolunteeringIndia.com (Experienz Travels) will only deal with any disputes or charges in India and is governed by Indian Law. All copyright issues including others will only be dealt in Indian court of Law. All disputes and cases will be solved in New Delhi, India only.

G. VolunteeringIndia.com (Experienz Travels) does not take any responsibility of photos and documentation provided by our partners and affiliations abroad, who might supply such material to other businesses of similar nature as well. If anyone has any objection to any part of the site, will write to us formally, for us to take appropriate action.

I. VolunteeringIndia.com (Experienz Travels) does not take any responsibility of any third party links from our site and will not be held responsible for content or service provided on those sites.
